In Spain, according to a report by CEL and CargoON, as many as 70% of carriers have to wait over an hour to load, significantly affecting their ability to complete orders on time. Similar challenges are observed in other European countries, where poor management of loading and unloading areas leads to significant delays, overtime costs, and additional operational expenses. 

This inefficiency impacts not only the financial results of transport companies but also the quality of services provided to customers, potentially leading to a loss of competitiveness in the market.

New legal framework: A solution on a European scale?

The introduction of Real Decreto Ley 3/2022 in Spain, which prohibits truck drivers of vehicles over 7.5 tons from performing loading and unloading tasks, could be a solution aimed at improving logistics efficiency. These regulations are designed to enhance driver safety and improve their working conditions, while also contributing to better organization of logistics processes.

One of the most controversial aspects of the new regulation is the ban on loading and unloading by drivers, which requires this activity to be compensated separately from the transport cost. The new rules also reduce the waiting time for loading or unloading to one hour before demurrage fees can be charged.

Both regulations directly impact logistics efficiency and costs, while protecting the rights of carriers.
